This Privacy Policy (the “Policy”) explains the types of information collected by Surpass Senior Living (“Surpass,” “we,” or “us”) in our role as the third-party manager of senior living communities (each, a “Community”). It also explains how we collect, use, and disclose that information through our website at https://www.surpass-living.com (the “Site”) and through other communication channels, including SMS text messaging.
By using the Site, or by providing your information to a Community managed by Surpass, you acknowledge that you understand and agree to this Policy. Surpass collects and processes information in coordination with the Communities and their ownership entities. If you do not agree to the terms of this Policy, please do not use the Site or provide your information.
We may update this Policy from time to time. Updates will be posted to the Site, and your continued use of the Site or engagement with a Community means you accept those changes.
This Policy applies solely to information collected by Surpass through the Site and our communications practices on behalf of the Communities we manage.
What Information Do We Collect?
- Personal Information You Provide to Us Surpass, acting on behalf of a Community, may collect personal information (such as name, date of birth, social security number, credit card number, mailing or billing address, telephone number, or email address) that you voluntarily provide via email, the Site, or direct contact.
- Information Collected by Automated Means When you use the Site, Surpass and our service providers may collect information about how the Site is accessed and used (“Usage Information”), including browser type, operating system, referring websites, and on-page activity.
- Device Identifiers We may collect unique identifiers for the device you use to access the Site (e.g., IP address, MAC address, or similar). These identifiers may be associated with your Personal Information to enhance the Site or provide tailored content.
- Cookies, Web Beacons, and Analytics The Site uses cookies, web beacons, and analytics tools (including Google Analytics and LocaliQ) to understand user behavior, track advertising effectiveness, and improve the Site experience.
How Do We Use Your Information?
Surpass uses your information, in coordination with the Community, to:
- Respond to inquiries and service requests.
- Provide registration, order, and billing functions.
- Conduct surveys, contests, or promotions (voluntary participation).
- Communicate updates, services, and policy changes unless you opt out.
- Support customer service and chat interactions.
Do you think we should share your information?
Surpass may share your information with trusted service providers who perform services on behalf of the Communities, including:
- Payment processing
- Advertising services
- Surveys and contests
- Analytics and reporting
- Customer relationship management
- Security and compliance
These providers may only use your data as necessary to deliver their contracted services.
We may also disclose Personal Information when required by law or when necessary to enforce policies, protect individuals or property, or in connection with a business transfer (e.g., if Surpass or a Community’s assets are acquired).

- Requests can be made directly to the Community you interact with, or to Surpass in our role as manager.

Your Texas Privacy Rights
If you are a Texas resident, the Texas Data Privacy and Security Act (TDPSA) provides specific rights regarding your personal data. These rights apply to data collected by a Community and processed by Surpass as its third-party manager.
Your rights include:
- Access – Confirm and obtain a copy of your personal data.
- Correction – Correct inaccuracies in your personal data.
- Deletion – Request deletion of your personal data.
- Portability – Obtain a copy of your data in a portable format.
- Opt-Out – Decline processing for targeted advertising, sale, or profiling.
Requests may be made to the Community or to Surpass directly. Surpass will coordinate with the Community’s ownership to respond. Surpass does not sell personal data.
SMS/Text Messaging Policy
By providing your phone number to a Community managed by Surpass, you consent to receive informational SMS text messages related to that Community.
- Source: Messages may come from the Community but are administered by Surpass in its capacity as the third-party manager.
- Purpose: Service-related updates only (e.g., appointments, family notifications, event notifications, urgent alerts).
- Consent & Opt-Out: You may opt out anytime by replying STOP or contacting the Community/Surpass.
- Frequency: Varies depending on your relationship with the Community, but limited to service-related updates.
- Charges: Standard carrier rates may apply.
- Privacy: Your phone number and SMS consent are not sold, rented, or shared with any third parties, affiliates, or marketing partners for promotional purposes. They are used solely to administer service-related communications on behalf of the Community.
Linked Websites
This Policy does not apply to third-party websites linked from the Site or a Community. Your data on those sites is governed by their privacy policies.
Children’s Privacy
The Site is not intended for children under 16. Surpass does not knowingly collect data from such individuals. If discovered, we will delete the information.
Data Security
Surpass uses physical, electronic, and procedural safeguards to protect information collected on behalf of Communities. However, no system is completely secure, and you are responsible for maintaining the confidentiality of your Site account credentials.
Limitation of Liability
To the maximum extent permitted by law, Surpass will not be liable for damages arising from our processing or use of Personal Information. Liability, if any, is limited to the greater of fees paid for the product/service or $100.
Miscellaneous
This Policy and Surpass’s privacy practices, in its role as third-party manager of Communities, are governed by the laws of the State of Texas, USA.
